TERMS AND CONDITIONS

Article 1.price of the stay

No dispute concerning the price of the stay can be taken into account after the signature of the contract. It is up to the tenant to assess, before signing, whether the price suits him.

Article 2.Duration of the stay

The renter/traveller signing the present contract concluded for a determined period of time will not be able to under any circumstances claim any right to remain in the premises at the end of the stay.

Article 3- Conclusion of the contract

The reservation becomes effective as soon as the lessee/traveller has sent to EI Domaine de Kerantroad

A deposit of 30% of the total amount of the rental (with a minimum amount equivalent to one night) will be cashed on receipt and an email of good reception will be sent to you. The payment of the deposit implies the acceptance of the general conditions of sale. The payment of the deposit can be made by cheque or PayPal.

The lease concluded between the parties hereto may in no case benefit even partially to third parties, individuals or legal entities, except with the written consent of EI Domaine de Kerantroad.

Any violation of the latter paragraph may result in immediate termination of the rental at the expense of the lessee/traveller, with the proceeds of the rental remaining definitively acquired by EI Domaine de Kerantroad.

Article 4- Absence of withdrawal

For bookings made by post, by telephone or by internet, the lessee/traveller does not benefit from the withdrawal period, in accordance with article L121-21-8 of the Consumer Code relating in particular to accommodation services provided on a specific date or according to a specific frequency.

By accepting the present contract, the client undertakes to stay on the domain on the dates indicated. He or she accepts the fact that no change in the date of stay will be possible.

Article 5- Cancellation by the lessee/traveller

All cancellations must be notified by registered letter with acknowledgement of receipt or electronically with acknowledgement of receipt to EI Domaine de Kerantroad.

a) Cancellation prior to arrival at the premises :

In the event of cancellation by the client 3 weeks or more before the start date of the stay, the operator will reimburse the client for the full amount of the deposit. If the cancellation occurs within 3 weeks prior to the stay, the deposit paid will be retained by the operator, regardless of the reason for the cancellation. In addition, EI Domaine de Kerantroad reserves the right to request the balance of the amount of the stay if the cancellation occurs less than 3 weeks before the planned date of entry into the premises.

b) if the stay is shortened :

The price of the accommodation remains entirely acquired at EI Domaine de Kerantroad. Additional services consumed will be due to EI Domaine de Kerantroad.

Article 6- Cancellation by the EI Domaine de Kerantroad

In the event of cancellation by EI Domaine de Kerantroad, the latter undertakes to inform the customer as soon as possible by telephone – on the telephone number, preferably mobile, indicated by the customer at the time of booking – and by electronic means with acknowledgement of receipt – on the e-mail address indicated by the customer at the time of booking.

In the event of cancellation by EI Domaine de Kerantroad, the latter shall return to the customer the full amount of the deposit it has paid, where appropriate, by terminating this contract.

Article 7- Arrival

The lessee/traveller must present himself on the day of the beginning of his stay from 5pm (availability time of the premises) and until 9pm at the latest. In the event of late or delayed arrival, the lessee/traveller must inform EI Domaine de Kerantroad.

If the lessee/traveller does not show up on the day of the planned start of the stay before 9pm, this contract becomes null and void, EI Domaine de Kerantroad reserves the right to dispose of the gîte. The deposit remains the property of EI Domaine de Kerantroad, which reserves the right to claim the balance of the price of the accommodation.

The secure access codes to the gîte will be sent by email with acknowledgement of receipt, the day before the arrival of the lessee/traveller. This code will be valid for the duration of his stay and will only allow access to the gîte reserved by the lessee/traveller.

Article 8- Departure

The departure time from the gîte must be no later than 10.30 am, beyond this time a supplement of 100€ will be charged.

We insist on the respect of the agreed time: the cleaning staff intervening on very short deadlines and on several lodgings, we ask you to facilitate the task to him, as we asked it to the tenants who preceded you.

The present rental having been granted only on a seasonal basis, the tenant undertakes to leave the premises at the date and time stipulated in the contract. As the tenant’s home address is indicated in the rental agreement, he is not entitled to sublet the premises.

Article 9- Means of payment and payment of the balance

The balance of the rent is paid on entering the premises, it can be made with the following means of payment:

-checks payable to Krystelle BAUTA-Domaine de Kerantroad,

-credit card,

-PayPal: secure dematerialized payment from a secure link sent to your mailbox.

For tenants who are not French residents, payments must always be made by bank transfer to the bank account indicated on the contract, all bank charges remaining the responsibility of the client, or by Paypal.

The invoice for the stay is issued after payment.

Article 10- Guarantee deposit or deposit of the Gîte

Upon arrival of the tenant, a security deposit of 500€ is required by EI Domaine de Kerantroad. After the contradictory establishment of the inventory of fixtures of exit, this deposit is returned, after deduction of the cost of restoration of the premises if damage was noted during the stay or after the departure of the tenants/travellers if these degradations have not been reported by themselves.

The security deposit can be paid by cheque or bank transfer and will be returned to the tenant/traveller within 7 to 10 working days.

Article 11- Inventory of fixtures of the lodging

According to Article 1731 of the Civil Code, the lessee/traveller accesses premises deemed to be in good condition. These premises are therefore clean, tidy and have furniture and equipment in good condition. The tenant has an inventory of the material/furniture constituting the rented gîte. The tenant has 1 hour to notify EI Domaine de Kerantroad by e-mail with photo, if he finds any discrepancies between the inventory he has and the state in which he found the premises.

The state of cleanliness of the gîte on the tenant’s arrival must be noted in the inventory of fixtures available in the accommodation. The cleaning of the premises is the responsibility of the tenant during the rental period.

On the day of departure, the tenant does not have to make an inventory of fixtures. On the other hand, the owner reserves the right to deduct all or part of the deposit in the event of damage noted and not declared before the tenant’s departure.

Article 12- Cleaning at the end of the stay of the lodging

A cleaning fee of 100€ is applied for any stay, the gîte must nevertheless have been maintained during your stay, leaving only the initial cleaning to be done by us. Crockery and utensils must be washed and put away, the dishwasher emptied, the gîte tidied up as on your arrival, the bathrooms and water, sanitary facilities and household appliances in a correct state proving regular maintenance, the barbecue cleaned etc. … Failing this, we will deduct 150€ from the deposit for “non maintenance of the accommodation during your stay”.

Article 12- Additional services

The possible additional services are to be paid at the convenience of the tenant / traveller, during or at the end of the stay, such as :

-Provision of additional household linen:

-Change of sheets during the stay : 15€/lit

-Change or extra towels/bath mats :5€/unit

-Change of bathrobe: 10€/unit.

– Rental charges included in a gîte rental: water, electricity up to 8kW/day – Gîtes de France standard – then 0.15 € per additional kW. A meter reading is taken on arrival and departure.

– Loan of baby equipment: high chair, cot, depending on availability. To be requested at the time of booking.

Article 14- Lifestyle/use of the premises

The lessee/traveller must ensure the peaceful nature of the rental and make use of it in accordance with the purpose of the premises, including indoor and outdoor common areas.

The lessee/traveller undertakes to return the gîte in perfect condition at the end of his stay and to declare, and take financial responsibility for, any possible damage for which he could be responsible.

The owner cannot be held responsible for the neighbourhood and their animals. The owner cannot be held responsible for the possible presence of mosquitoes and various insects, nor for irregularities and/or lack of use that may occur in the electricity (WIFI cut off in case of wind and/or bad weather), mobile phone, etc… and declines all responsibility for lack of use not resulting from his fault. Similarly, the owner cannot be held responsible for the weather, preventing the tenant from taking full advantage of his stay, the swimming pool area or the proposed exteriors made available to him.

Article 15- Capacity

This contract is established for a maximum capacity of persons. If the number of renters/travellers exceeds the capacity, EI Domaine de Kerantroad may refuse the additional persons. Any modification or termination of the contract will be considered at the client’s initiative.

Article 16- Children

Children are under the sole responsibility of their parents or persons having authority over them. Children under 2 years of age stay free of charge if they do not use the available bedding.

Article 17- Outdoor relaxation area
Sauna/jacuzzi area

Access 9:30-23:00. Its use is reserved only for members of the Domaine de Kerantroad family and people staying in the gîtes. The use of the sauna and jacuzzi is not allowed to guests visiting our tenants/guests. The use of the sauna and jacuzzi by children is under the full supervision and responsibility of their parents. Users of the outdoor relaxation area undertake not to use the towels in the rooms that are not intended for use outside the rooms. Furniture may not be moved outside the relaxation area. Any games too noisy for other guests as well as, any throwing of objects is forbidden in and around the relaxation area. On repeated breaches, the authorization previously granted access to the outdoor recreation area may be withdrawn without compensation of any kind from the EI Domaine de Kerantroad. The jacuzzi is not supervised. No child under 12 years old and/or unable to swim, can move in the relaxation area without the presence of a parent. The EI Domaine de Kerantroad declines all responsibility in case of accident. Access to the sauna and jacuzzi can be privatized for 2 hours per day. The reservation must be made the day before by indicating the desired time slot with the EI Domaine de Kerantroad, according to the terms indicated in the welcome booklet.

The jacuzzi is heated for the session between 35° and 40°, the sauna between 50° and 60°.

The Jacuzzi and sauna can only accommodate 6 people at a time.

Children under 12 years of age are strongly advised not to use the sauna.

It is forbidden to bring animals, even momentarily, into this area.

It is forbidden to jump and/or dive in the jacuzzi. –

Sexual intercourse and/or urinating in the jacuzzi and/or sauna is not permitted.

It is forbidden to eat in the relaxation area.

– The sauna will be used in 3 to 4 sessions of 5 minutes maximum, interspersed with 2 to 3 minutes of recovery, for health reasons (see contraindications).

– The use of the jacuzzi will be done in 1 session of 30 to 40 minutes maximum, for health reasons (see contraindications).

– The user undertakes to be vigilant so that the session takes place in good conditions, in accordance with these GCS and the recommendations previously given by the owner.

Contraindications to the use of the Sauna and Jacuzzi

The sauna and jacuzzi are contraindicated for people with heart problems, high or low blood pressure and circulatory problems. If the user suffers from kidney problems, diabetes, epilepsy or in case of pregnancy, heat baths should also be avoided. The use of alcohol, drugs or antihypertensive medication is strongly discouraged before a session. Avoid going to the sauna and jacuzzi during the digestion phase. It is preferable to wait at least two hours after a large meal before going there. If the user tries to quit smoking and wears patches, remove them. The increased blood flow through the skin promotes the absorption of the substances. In a jacuzzi (35 to 40°) but especially in a sauna (50 to 60°), the user must listen to his body. During the first sessions, it is advisable to stay in the cabin for a short time and to return several times to accustom your body to the heat. For this reason, each sauna session should last only 5 minutes, renewable three times maximum. The user should also take care to get up slowly when going out to avoid dizziness. Moreover, as he will sweat, it is important to drink at least one glass of water after the sauna.

Outdoor play area

Outdoor games (molky, pétanque, Breton palets) are made available free of charge to tenants/travellers by EI Domaine de Kerantroad. We invite our guests to take care of them and put them away every evening.

In the event of damage to equipment not immediately reported to EI Domaine de Kerantroad, repair/replacement costs will be charged to all Domaine de Kerantroad tenants, either in 1 or 2 gîtes depending on the period of presence. The costs will be deducted from the deposit.

It is recommended that all users of the sauna and jacuzzi be covered by a Civil Liability insurance defence and recourse.

Article 18- Indoor relaxation area

Access from 10am to midnight. Its use is reserved only for members of the Domaine de Kerantroad family and people staying in the gîtes. The use of the equipment provided inside is not allowed to guests visiting our tenants/travellers. Children in this area remain under the full supervision and responsibility of their parents. Furniture cannot be moved outside the relaxation area. The video equipment, billiards, table football, are provided free of charge by EI Domaine de Kerantroad, it is up to the tenants / travelers to take care of it. In case of damage to equipment not immediately reported to EI Domaine de Kerantroad, the cost of repair / replacement will be charged to all tenants of the Domaine de Kerantroad, either 1 or 2 cottages depending on the period. The costs will be deducted from the deposit.

Any games too noisy for other guests as well as, any throwing of objects is prohibited in and around the relaxation area. On repeated breaches, the previously granted permission to access the outdoor recreation area may be withdrawn without compensation of any kind on the part of EI Domaine de Kerantroad.

Article 19- The enclosure of animals on the estate

Access to the paddock is forbidden to tenants/travellers. The enclosure being electrified, for your safety, it is strongly advised not to enter it. Children wishing to observe the residents of the domain may do so under the supervision of their parent or an adult. If they wish, children and/or tenants/travellers are welcome to participate in animal care activities and egg collection. Simply make a request to the owners of the Kerantroad estate. Contact details are indicated in the welcome booklet.

It is forbidden to feed the animals.

Article 20- Linen

Linen is provided (gîte: sheets, 2 towels and gloves room/person, 1 bath mat/bathroom, bathrobe/person, beach towel/person, 2 tea towels). A change or supplement of towel or bath mat is charged 5€/unit. A change of bed linen during your stay is charged 15€/bed. A change of bathrobe is charged 10€/unit. Sheets, towels, gloves, bath mats and tea towels can be changed free of charge for the gîte on request on a weekly basis. The towels in the rooms or the gîte are not to be used for the outside relaxation area. The beach sheets are to be used exclusively inside the domain.

Article 21- Pets

To be announced when I book my stay. Supplement of 5€/night + deposit of 300€. For allergy reasons, cats are not allowed. Wise and docile dog accepted in the gîtes (only one animal accepted per accommodation). The animal must at no time remain alone locked up in the gîte in the absence of its masters. Animals are not accepted in the interior and exterior relaxation areas. Access to the bed and the sofa is not allowed to the animal. The owner of the animal undertakes to make his animal sleep in his basket/bed provided for this purpose and to bring the necessary to guarantee the cleanliness of the premises. Outside the animal must be kept on a leash. The animal’s excrements will have to be systematically collected by the owner of the animal. The owner of the animal agrees to pay for any damage caused by his animal in his reserved accommodation and / or on the entire site of Domaine de Kerantroad. If on the day of arrival, the lessee/traveller arrives accompanied by one or more unannounced animals, refusal to accept the animals by EI Domaine de Kerantroad cannot be assimilated to a modification or breach of contract at the initiative of EI Domaine de Kerantroad, so that in the event of the lessee/traveller’s departure, no reimbursement can be envisaged. Owners must ensure that their pets leave the loaned premises clean.

Article 22- Cigarette

The establishment is non-smoking, smokers must go to the gardens and use the ashtrays provided, in which case they will be charged 50€ for the collection of their cigarette butts.

Article 23- WIFI

WIFI access is offered free of charge from a secure identification page. All access to prohibited sites and downloads other than email are prohibited, the responsibility of offenders is engaged. EI Domaine de Kerantroad reserves the right to report illegal downloads and browsing on prohibited sites to the competent authorities.

The WIFI connection is accessible throughout the entire domain for the duration of your stay.

Article 24- Insurance

The lessee/traveller is liable for all damages arising from his or her actions. He is required to be insured by a multi-risk holiday-type insurance contract in order to cover any damage caused during his stay.

The insurance also intervenes in case of cancellation of the rental for reasons of death, accident or serious illness, it is valid from the day of signature of the contract until the end of the rental.

The personal effects, whatever they are, remain under the sole responsibility of the owner.

EI Domaine de Kerantroad shall not be held liable for loss, theft and/or damage or injury to property and/or persons on the property.

Article 25- Tourist tax

The tourist tax is a local tax and is not included in the price of accommodation. It is collected by EI Domaine de Kerantroad on behalf of the municipality of Plonevez-porzay and is paid to the Treasury.

It is included in the contract and due on arrival in the gîte.

Article 26- Obligations of the owner

The owner is required to :

– Deliver the rented premises in good condition for use and repairs, as well as the equipment mentioned in the contract in good working order.

– Ensure the tenant’s peaceful enjoyment of the rented premises and guarantee him/her against any defects and faults likely to hinder it.

– Maintain the accommodation in a condition to be used for the intended purpose.

– To provide towels and bed linen to the tenants of its lodgings.

Article 27- obligations of the tenant

The accommodation is handed over to the tenant in a perfect state of cleanliness and storage, the household appliances are clean and in perfect working order, the premises (inside and outside) are free of any marks of degradation whatsoever.

The tenant is required to :

– Acknowledges that the seasonal rental is concluded as a temporary residence and pleasure craft. The premises may not be used as a main or even secondary residence and the tenant may not engage in any commercial, craft or professional activity.

– The tenant must behave like a good father and ensure the good maintenance of the accommodation during his stay.

– Return the accommodation (gîte) just as clean and tidy at the end of his stay (washing and tidying of the dishes done, sheets and towels collected, barbecue and household appliances cleaned, floors washed, bins removed…).

– Furniture and furnishings should only suffer depreciation resulting from the normal use for which they are intended. Those which, at the end of the rental period, will be missing, will not have been maintained or will have been taken out of service, for a cause other than normal wear and tear, will have to be paid for (or replaced by the tenant with the owner’s consent). This clause also applies to painted walls, frames and the building in general (interior and exterior).

– The tenant is obliged to use the furniture and objects furnishing the dwelling for the use for which they are intended and in the places where they are located. He formally refrains from transporting them outside the rented premises (in particular bedding, crockery, chairs, etc.).

– Do not sleep in the same place as the sheet, bedding or blankets. The price of washing or cleaning of blankets, mattresses, bedding, etc… which have been stained will be retained if necessary.

– Not to do anything which, by his own doing or by his family or relations, could harm the tranquillity of the neighbourhood or the other occupants.

– The tenant must absolutely refrain from throwing into the washbasins, baths, showers, sinks, toilets, etc… objects likely to obstruct the drains (wipes, tampax, cotton swabs, sanitary towels, etc.), failing which, he will be liable for the costs incurred to repair these appliances.

– Immediately inform the owner of any damage and deterioration occurring in the dwelling, even if no apparent damage results.

– To be responsible for any damage and loss that occurs by his own fault or by the fault of persons in his house, during the enjoyment of the dwelling, unless he proves that they took place without his fault or that of the aforementioned persons.

Article 29- Options

Options are proposed on the booking contract of our gîtes

– Rental charges included in a gîte rental: water, electricity up to 8kW/day – Gîtes de France standard – then 0.15 € per additional kW. A meter reading is taken on arrival and departure. – Loan of baby equipment: high chair, cot, depending on availability. To be requested at the time of booking.

Article 30- Data processing and liberties

In accordance with the law of 6 January 1978, you have the right to access and rectify data concerning you. EI Domaine de Kerantroad undertakes not to transmit the information you have provided to other companies or organizations.

These terms and conditions of sale may be modified at any time without prior notice.
